These Terms and Conditions govern all sales of products by Swiss AG, whether conducted through our online store, directly to consumers, or through trade, dealer, and business channels, unless otherwise agreed in writing.

2.5 Agreement means the contract formed upon acceptance of an order by Swiss AG.
3. APPLICATION OF TERMS
3.1 These Terms apply to all quotations, sales, deliveries, and transactions unless expressly agreed otherwise in writing.
3.2 No variation or waiver shall be binding unless reduced to writing and signed by Swiss AG.
3.3 Any conflicting customer terms are expressly excluded.

5. PRICING
5.1 All prices are quoted in South African Rand (ZAR) and include VAT, unless otherwise stated.
5.2 Swiss AG reserves the right to correct any pricing errors prior to dispatch.
5.3 Trade, wholesale, and promotional pricing may be subject to special terms and minimum order quantities.
6. ORDER ACCEPTANCE
6.1 An order is deemed accepted only once:
Payment has been received (where applicable), and
A formal order confirmation has been issued by Swiss AG.
6.2 Swiss AG reserves the right to refuse or cancel any order at its sole discretion.
7. PAYMENT TERMS
7.1 Online Store Purchases: Payment must be made in full at checkout via approved payment gateways.
7.2 Trade / Account Customers: Payment terms will be as agreed in writing, typically COD or within 30 days from invoice.
7.3 Late payments may attract interest at the maximum rate permitted by law.
7.4 Ownership of products remains with Swiss AG until full payment has cleared.
8. DELIVERY
8.1 Delivery times provided are estimates only and not guarantees.
8.2 Delivery charges are calculated at checkout or agreed in writing for trade customers.
8.3 Risk in the goods transfers to the Customer upon delivery.
8.4 Swiss AG shall not be liable for delays caused by acts of God, logistics partners, industrial action, or circumstances beyond our control.
8.5 The Customer must inspect goods on delivery and report visible damage within 48 hours.
9. RETURNS, COOLING-OFF & CPA RIGHTS
9.1 CPA Cooling-Off Period (Online Purchases)
Customers purchasing online are entitled to a 7-day cooling-off period from the date of delivery, subject to:
Products being unused
In original packaging
All accessories included
Return shipping during cooling-off is for the Customer’s account unless the product is defective or incorrectly supplied.
9.2 Defective Products
In terms of the CPA, customers are entitled to repair, replacement, or refund for defective goods within 6 months of delivery, provided:
The defect was not caused by misuse, power surges, incorrect installation, or neglect.
Normal wear and tear is excluded.
9.3 Exclusions
Returns will not be accepted for:
Products damaged by misuse, negligence, or unauthorized repairs
Electrical damage due to power surges or improper voltage
Products not in original condition and packaging

11. LIMITATION OF LIABILITY

12.2 Swiss AG shall not be liable for damage arising from improper installation, electrical irregularities, or non-compliance with safety standards.
13. POPIA & DATA PRIVACY
13.1 Swiss AG collects and processes personal information strictly in accordance with POPIA.
13.2 Customer data is used solely for:
Order fulfillment
Customer communication
Legal and accounting compliance
13.3 We do not sell or trade customer information to third parties.
14. INTELLECTUAL PROPERTY

19. VERSION CONTROL
These Terms may be updated from time to time. The version published on the Swiss AG website at the time of purchase shall apply.
At Swiss AG we want you to enjoy your appliances with confidence. This warranty is in addition to your legal rights under the Consumer Protection Act (CPA) and applies to all products sold in South Africa through any sales channel, including retailers, online stores, and distributors.
1. YOUR RIGHTS IN THE FIRST 6 MONTHS
All products come with a statutory 6-month warranty under the CPA.
If your appliance develops a fault within the first 6 months of purchase, you have the right to choose:
• Repair,
• Replacement, or
• Full Refund.
We may request an inspection by an authorised service agent to confirm the issue.
If the same problem happens again after repair, you are entitled to a replacement or refund.
2. EXTENDED MANUFACTURER WARRANTY
After the first 6 months, Swiss AG provides a limited manufacturer’s warranty for the remaining period:
• Small appliances (kettles, irons, toasters, air fryers, vacuum cleaners)
o Domestic: 12 months
o Commercial/semi-commercial: 6 months
• Large domestic appliances (fridges, freezers, dishwashers, dryers, wine coolers)
o Domestic: 24 months
o Commercial/semi-commercial: 12 months
The period above indicates the time from date of purchase and is not in addition to the 6 months referred to in clause 1 above.
During this period, we may repair or replace your product at our discretion. Replacement units inherit the original warranty period and do not reset the term.
3. WHO CAN CLAIM
You need a proof of purchase to make a claim. Acceptable documents include:
• Retail invoice
• Online order confirmation
• Delivery note
• Bank or card statement showing the purchase
4. AUTHORISED REPAIRS ONLY
Warranty repairs must be done by a Swiss AG-authorised service agent.
• Repairs by unauthorised technicians void the warranty.
• Only approved spare parts may be used.
• Each authorised repair comes with a 3-month workmanship and parts warranty for the work performed.
5. BUILT-IN & PORTABLE APPLIANCES
• Built-in appliances: On-site service within 50 km of a major town or city. Remote or difficult locations may have additional fees.
• Portable appliances: Must be returned to the original purchase point or authorised service centre.
6. WHAT’S NOT COVERED
Our warranty does not cover:
• Normal wear and tear
• Cosmetic damage
• Consumables (bulbs, filters, seals, trays, knobs, handles)
• Damage from misuse, neglect, incorrect installation, or use outside intended purpose
• Electrical damage if proper surge protection was not used
• Acts of God (fire, flood, hail, lightning, extreme weather)
We do cover defects caused by faulty materials or workmanship in the original manufacturing process.
7. TRANSPORTATION
• If we arrange collection, risk remains with Swiss AG.
• If you arrange delivery to a service centre, risk remains with you.
• Original packaging is recommended; damage due to inadequate packaging is the customer’s responsibility.
8. YOUR RIGHTS
Nothing in this warranty affects your legal rights, including:
• Protection against death or personal injury caused by our negligence
• Product liability under the CPA
• Any other non-waivable rights
